This Privacy Notice (“Notice”) describes how Enercon Engineering, LLC and its subsidiaries and affiliates (“Enercon,” “we,” “our,” or “us”) collect, use, disclose, and otherwise process information, including information that identifies you as an individual or relates to an identifiable individual (“Personal Information”). Any dispute concerning privacy is subject to this Notice. Your use of our websites, products, services, and other offerings is also subject to our applicable terms and conditions, including any terms governing limitations on damages and the resolution of disputes.

This Notice applies to Enercon’s websites, products, services, marketing activities, and digital interactions that link to or reference this Notice. This may include:

We are also not responsible for the information collection, use, disclosure, or security practices of other organizations, including social media platforms, operating system providers, email service providers, wireless service providers, device manufacturers, analytics providers, advertising networks, or other third-party service providers.
3. Use of System by Children
Our System is not intended for children under 16 years of age. We do not knowingly collect Personal Information from children under 16. If you are under 16, do not provide any information on or through the System, make any purchases through the System, use any interactive or public comment features of the System, or provide any information about yourself to us, including your name, address, telephone number, email address, screen name, or username.
If we learn that we have collected or received Personal Information from a child under 16 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 16, please contact us using the information listed in the “Contact Information” section below.

Directly from you when you voluntarily provide it to us through the System or offline, such as when you request product or service information, submit a quote request, contact customer service, register for communications, complete a form, participate in a survey, attend a trade show, or otherwise communicate with us.

From form submissions on our System, including information provided when requesting further services from Enercon or one of our representatives.

From our business partners and other third parties, provided that such parties confirm to us that, where required by applicable law, you have consented to or otherwise authorized the disclosure of your Personal Information to Enercon.

We need to collect certain Personal Information in order to provide requested services, respond to inquiries, process transactions, support customer relationships, or comply with legal obligations. If you do not provide requested information, we may not be able to provide the requested products, services, or communications.
If you disclose Personal Information relating to other people to us or to our service providers in connection with the System, you represent that you have the authority to do so and to permit us to use the information as described in this Notice.
5. Other Information We Collect Through Automatic Data Collection Technologies
As you navigate through and interact with our System, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns. “Other Information” is information that does not reveal your specific identity or does not directly relate to an identifiable individual, including:

Details of your visits to our System, including traffic data, usage data, communication data, and the resources you access and use;

Information about your computer, device, and internet connection, including IP address, operating system, browser type, device type, and referring URLs;

Information collected through cookies, pixels, tags, analytics tools, and similar technologies.
The Other Information we collect helps us improve our System, products, services, marketing, and user experience, including by enabling us to:

We may use and disclose Other Information for any purpose, except where required to do otherwise under applicable law. In some instances, we may combine Other Information with Personal Information. If we do, we will treat the combined information as Personal Information for as long as it is combined.
6. Collection of Other Information
We and our service providers may collect Other Information in a variety of ways, including the following.

Through Your Browser or Device
Certain information is collected by most browsers or automatically through your device, such as computer type, device type, operating system name and version, device manufacturer and model, language, browser type and version, screen resolution, and the name and version of the System service you are using. We use this information to help ensure that the System functions properly.

Cookies and Pixel Tags
A cookie is a small file placed on the hard drive of your device, such as a phone, tablet, or computer. Cookies are pieces of information stored directly on the device you are using. We may use cookies to collect information such as browser type, time spent on the System, pages visited, language preferences, and other traffic data.
We and our service providers use this information for security purposes, to facilitate navigation, to display information more effectively, to personalize your experience, and to gather statistical information about the use of the System so we can improve its design and functionality. Cookies may also allow us to select advertisements, offers, or content that may be relevant to you and display them while you are using the System or other websites.
We do not currently respond to browser “do not track” signals.
You may refuse to accept browser cookies by activating the appropriate setting on your browser. You may also wish to refer to publicly available resources about managing cookies. However, if you select this setting, you may be unable to access certain parts of our System. Unless you have adjusted your browser setting so that it will refuse cookies, our system may issue cookies when you direct your browser to our System.
We may use pixel tags, also known as web beacons or clear GIFs, to track the actions of users of the System, including email recipients, measure the success of marketing campaigns, and compile statistics about usage of the System and response rates.
Enercon may use web analytics tools, such as Google Analytics or similar technologies, to understand website visits, traffic sources, user behavior, and campaign performance. Information generated by cookies or similar technologies about your use of our System may be transmitted to and stored by analytics providers on servers in the United States or other locations. These providers may use this information to evaluate your use of our websites, compile reports on website activity, and provide other services relating to website activity and internet usage.
Where available, you may opt out of certain analytics tracking by using tools provided by the applicable analytics provider.
IP Address
An IP address is automatically assigned to your computer or device by your internet service provider. An IP address may be identified and logged automatically in our server log files whenever a user accesses the System, along with the time of the visit and the pages visited. Collecting IP addresses is standard practice and is done automatically by many websites, applications, and other services.
We use IP addresses for purposes such as calculating usage levels, diagnosing server problems, administering the System, improving security, and deriving approximate location.
Location
We may derive your approximate location from your IP address or other technical information. If we offer services that request precise device location, we will collect that information only as permitted by your device settings, browser settings, consent preferences, or applicable law.
7. How We Use Your Information
We use Personal Information that we collect about you or that you provide to us for various purposes, including the following.

8. Disclosure of Your Information
We may disclose information about our users in aggregated or de-identified form, as well as other information that does not identify or is not reasonably linkable to any individual, as permitted by law. We may disclose aggregated or de-identified information in analyses and reports derived from such information to third parties, including service providers, suppliers, advertisers, marketing partners, research companies, and other organizations.
We may disclose Personal Information that we collect or that you provide as described in this Notice:

You may elect to provide Personal Information to be published or displayed on public areas of the System, or transmitted to other users of the System or third parties (“User Contributions”). We cannot control the actions of other users of the System with whom you may choose to share your User Contributions. Therefore, we cannot guarantee that your User Contributions will not be viewed by the general public.
We may also use and disclose your Personal Information as necessary or appropriate, especially when we have a legal obligation or legitimate interest to do so:

To cooperate with law enforcement or comply with any court order, law, legal process, government authority, or regulatory request;

If the System or an Enercon product or service is provided through or in connection with a third party, such as a dealer, reseller, representative, contractor, distributor, business partner, payment processor, hosting provider, or other service provider, that third party may collect, store, disclose, or use your information according to its own privacy practices. We cannot control and are not responsible for the privacy practices of such third parties, except where required by applicable law.
9. Data Integrity and Retention
Enercon will take reasonable steps to help confirm that Personal Information about you is accurate, complete, and up to date. We retain Personal Information for as long as needed or permitted in light of the purposes for which it was obtained and consistent with applicable law.
The criteria used to determine our retention periods include:

The length of time we have an ongoing relationship with you and provide the System, products, or services to you;

Whether there is a legal obligation to which we are subject, such as laws requiring us to keep certain records for a specified period;

10. Choices and Access
Users of our System in certain jurisdictions may have rights in relation to the Personal Information we collect about them. Depending on applicable law, you may have the right to request to review, correct, update, suppress, restrict, or delete Personal Information; object to the processing of Personal Information; or request to receive an electronic copy of your Personal Information for purposes of transmitting it to another company.To make such a request, you may contact us using the information listed in the “Contact Information” section below. We will respond to your request consistent with applicable law.
When you provide us with Personal Information through our website, System, product inquiry, quote request, newsletter signup, or other form, you may be offered the opportunity to subscribe to and receive additional information about our products and services by email. You may opt out of future marketing emails by using the unsubscribe link included in commercial email communications or by contacting us. We may take up to ten (10) business days to process opt-out requests.
11. Data Security
Enercon uses reasonable administrative, technical, and physical safeguards designed to help protect Personal Information from unauthorized access, use, disclosure, alteration, or destruction.
For any websites, portals, or systems to which you log in, it is your responsibility to help protect the security of your account credentials and not to disclose passwords or other access information to others.
Notwithstanding the foregoing, no website, system, transmission, database, or storage method is completely secure. Enercon cannot guarantee that the System or your Personal Information cannot be compromised or accessed without authorization. If you have specific security-related concerns, please contact us using the information listed in the “Contact Information” section below.
12. Third-Party Advertising
We may use third-party advertising companies, analytics providers, social media platforms, or marketing service providers to serve advertisements or measure the effectiveness of our marketing campaigns when you access and use the System or other websites and online services.
You may receive advertisements based on information relating to your access to and use of the System and other websites or online services, as well as information received from third parties. These companies may place or recognize a unique cookie or similar technology on your browser or device, including through the use of pixel tags. They may use these technologies, along with information they collect about your online activity, to recognize you across devices such as a mobile phone, tablet, and laptop.
To learn more about interest-based advertising and available opt-out tools, you may visit industry resources such as the Digital Advertising Alliance or Network Advertising Initiative. You may also adjust your browser, device, or platform settings to limit certain types of tracking or advertising.
13. Third-Party Payment Services
We may use a third-party payment service to process payments made through the System. If you make a payment through the System, your Personal Information may be collected by the third-party payment processor and not directly by us. Such information will be subject to the third party’s privacy policy rather than this Notice. We have no control over, and are not responsible for, the third party’s collection, use, or disclosure of your Personal Information, except where required by applicable law.
14. Sensitive Information
Unless we specifically request it, we ask that you not send us, and not disclose to us, any sensitive Personal Information through the System or otherwise. Sensitive Personal Information may include social security numbers, driver’s license numbers, passport numbers, information related to racial or ethnic origin, political opinions, religion or other beliefs, health information, biometric or genetic characteristics, criminal background, trade union membership, or other sensitive data as defined by applicable law.
15. Jurisdiction and Cross-Border Transfer
The System is hosted in the United States and is subject to United States law. We may share your Personal Information internally with our affiliates and with other recipients as described in this Notice. These recipients may be located in countries other than your country of residence.
If you access the System from outside the United States, please be advised that the United States and other countries may not offer the same privacy protections as the laws of your jurisdiction. In certain circumstances, courts, law enforcement agencies, regulatory agencies, or security authorities in the United States or other countries may be entitled to access your Personal Information.

The CCPA defines “sale” as disclosing or making available personal information to a third party in exchange for monetary or other valuable consideration. The CCPA defines “sharing” as disclosing or making available personal information to a third party for purposes of cross-context behavioral advertising. We may “sell” or “share” certain personal information as described below, including through third-party advertising networks, analytics providers, and social media platforms for marketing, advertising, analytics, and campaign measurement. We do not knowingly sell or share personal information about individuals under age sixteen (16).

Purposes of Collection, Use, and Disclosure
In general, we may collect, use, disclose, and otherwise process personal information for the following business or commercial purposes and as otherwise directed or consented to by you:

· To provide products, services, quotes, information, support, and customer service;
· To provide newsletters or other marketing materials;
· For business reporting, analytics, and personalized services;
· To allow participation in surveys, promotions, events, contests, or similar activities;
· To aggregate or de-identify personal information;
· To accomplish our business purposes;
· To cooperate with law enforcement and governmental authorities;

For de-identified information, we will maintain and use de-identified information in that form and not attempt to re-identify it, except as permitted by applicable law, such as to test and analyze our de-identification processes.
Retention
We retain the personal information we collect only as reasonably necessary for the purposes described above, or as otherwise disclosed to you at the time of collection, and consistent with applicable law. For more information, please see the “Data Integrity and Retention” section above.
Sensitive Personal Information
We use and disclose sensitive personal information only as reasonably necessary and proportionate for permitted purposes under applicable law, including to perform services requested by you; help ensure security and integrity; prevent, detect, and investigate security incidents; detect and respond to malicious, fraudulent, deceptive, or illegal conduct; verify or maintain the quality and safety of our services; comply with legal obligations; and work with service providers who perform services on our behalf.
Unless otherwise disclosed, we do not use or disclose sensitive personal information for purposes of inferring characteristics about you.
California Resident Rights
Subject to certain conditions and exceptions, California residents may have the following rights with respect to their personal information:

· Right to Opt Out of Sales and Sharing: You may request to opt out of “sales” and “sharing” of your personal information, as those terms are defined under the CCPA.
· Right to Limit Use and Disclosure of Sensitive Personal Information: You may request to limit certain uses and disclosures of sensitive personal information.
· Right to Non-Discrimination: You have the right not to be subjected to discriminatory treatment for exercising privacy rights described in this section.

You may designate an authorized agent to submit requests and act on your behalf. Authorized agents may be required to provide proof of authorization, and we may require that the relevant consumer directly verify their identity and the authority of the authorized agent.
Notice of Financial Incentive
We may make available programs, offerings, surveys, promotions, contests, or similar activities that may include rewards, discounts, services, perks, or promotional offers (“Programs”). These Programs may be considered “financial incentives” under the CCPA. We may collect, disclose, and retain personal information about individuals as part of these Programs.
These Programs may involve making available rewards or offers to customers, prospects, or partners that participate in a customer satisfaction survey, market research survey, feedback request, event, promotion, or similar activity. To participate, you may be required to provide certain personal information, such as name, email address, company, job title, contact information, and feedback or responses. This may include IT, administration, direct costs, third-party costs, discounts, service development costs, and related expenses.
You may withdraw from a Program at any time by contacting us using the information listed in the “Contact Information” section below. If you withdraw from a Program or submit a request to delete your information, your participation in that Program may be terminated, which means you may no longer be eligible to earn, use, access, or redeem Program rewards or offers, subject to applicable Program terms.

California Civil Code Section 1798.83 permits California residents who use our System to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes.
